Terms & Conditions

These Terms & Conditions apply to all guitar tuition services provided by Gigatar ABN 49 697 366 359 (“we”, “us”, “our”) to the student or their parent/guardian (“you”).


1. Lessons

a) Lessons are delivered on a one-on-one basis unless otherwise agreed.

b) Standard lesson duration is 30 minutes, or 60 minutes if otherwise agreed.

c) Lessons may be conducted in-person or online, as agreed.

d) Students are expected to attend on time and be reasonably prepared.


2. Fees & Payment

a) Lesson fees are will be communicated to you prior to the lesson. 

b) Fees are payable at the end of each lesson, by either cash, card or EFT. 

c) Failure to make payment may result in suspension of lessons until payment is received.


3. Cancellations & Rescheduling

a) A minimum of 24 hours’ notice is required to cancel or reschedule a lesson.

b) Lessons cancelled with less than 24 hours’ notice, or missed without notice, may be forfeited and charged in full.

c) We will make reasonable efforts to reschedule lessons where notice is provided.

d) If we cancel a lesson, a make-up lesson or credit will be offered.


4. Student Responsibilities

a) Students must bring their own guitar and any required materials unless otherwise agreed.

b) Students are responsible for the care and condition of their own instruments and equipment.

c) For students under 18, a parent or guardian is responsible for supervision (where required) and compliance with these terms.


5. Intellectual Property

a) All lesson materials created by Gigatar, including printed materials, worksheets, exercises, recordings, and other original content (“Materials”), are owned by Gigatar and are protected by copyright and other intellectual property laws.

b) You are granted a non-exclusive, non-transferable licence to use the Materials solely for your personal learning purposes.

c) You must not copy, reproduce, distribute, publish, share, or create derivative works from the Materials, in whole or in part, without our prior written consent.

d) The Materials may include or reference musical works, compositions, or excerpts created by third-party artists or rights holders (“Third-Party Works”). Gigatar does not claim ownership of any Third-Party Works. Ownership of such works remains with the relevant copyright owners.

e) Any Third-Party Works are used solely for the purposes of instruction, demonstration, or education, and are attributed where reasonably practicable.

f) Nothing in these Terms grants you any rights to use, reproduce, or exploit Third-Party Works beyond what is permitted under applicable copyright law.

g) This clause survives termination of lessons.


6. Communication (Minors)

a) For students under the age of 18, all communications outside of the one-on-one lesson (including scheduling, reminders, feedback, and additional information) will be directed to a parent or guardian.

b) Gigatar will not directly contact minor students via phone, text message, or messaging applications.

c) The parent or guardian is responsible for facilitating communication between Gigatar and the student.

d) Where messaging platforms (such as WhatsApp) are available, a parent or guardian may setup a group to simplify communications. The parent or guardian must be included in that group communication, and is agrees to actively monitor all communications.


7. Safety and Background Checks

a) Gigatar maintains a valid Working With Children Check (WWCC) which can be provided for review upon request.

b) If not included in the WWCC, Gigatar will also undertake a separate police check at or around the time of obtaining or renewing the WWCC, which can be provided for review upon request.

c) These measures are intended to provide assurance to parents and guardians regarding safety and suitability.


8. Liability

a) To the extent permitted by law, Gigatar is not liable for any loss, damage, or injury arising from participation in lessons, except where caused by our negligence.

b) Personal property (including instruments) is brought to lessons at your own risk.


9. Consumer Guarantees

a) Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

b) Nothing in these Terms excludes, restricts, or modifies any rights you may have under applicable law.


10. Termination

a) Either party may discontinue lessons at any time by providing reasonable notice.

b) Any prepaid lessons will be honoured or refunded at our discretion, subject to these Terms.


11. Media & Communications 

a) We may occasionally use photos or recordings of lessons for educational or promotional purposes.

b) We will seek your consent before using any identifiable content.


12. Changes to Terms

We may update these Terms from time to time. Updated Terms will apply from the date they are provided or published.

13. Acceptance

By booking or attending lessons, you agree to these Terms & Conditions.
